Mariah Carey<\/a>\u00a0has been awarded $92,000 after a judge dismissed a lawsuit relating to her hit \u2018All I Want\u00a0For\u00a0Christmas Is You\u2019.<\/p>\n The country singer Andy Stone \u2013 who performs under the stage name Vince Vance \u2013\u00a0first filed a suit against Carey in a Los Angeles federal court in November 2023<\/a>. He alleged that Carey\u2019s song infringed the copyright of his 1989 song of the same name and that the pop singer had exploited his \u201cpopularity\u201d and \u201cstyle\u201d.<\/p>\n \u201cIf you look at both songs, you can see that about 50 per cent of the words are the same, in\u00a0almost the\u00a0same order. I think\u00a0it\u2019s\u00a0a\u00a0pretty strong\u00a0claim,\u201d the\u00a0plaintiff\u2019s\u00a0lawyer, Douglas M. Schmidt, said at the time.<\/p>\n In March,\u00a0Judge Monica Ramirez\u00a0Almadini\u00a0ruled that Stone\u2019s lawyers had not \u201cmet their burden of showing\u201d that the two songs were \u201csubstantially similar\u201d<\/a>,\u00a0instead citing expert testimony that asserted that the two songs simply shared \u201cChristmas song cliches\u201d that had been present in several earlier songs.<\/p>\n\n Now, court documents have revealed that the judge has ordered Stone to pay Carey $92,303.20 (\u00a368,294.33) in sanctions,\u00a0saying\u00a0that the suit lacked merit\u00a0and arguing that the sanctions were intended to deter similarly baseless lawsuits.\u00a0Stone had been\u00a0seeking\u00a0at least $20million (\u00a316million) in damages.<\/p>\n In November last year,\u00a0Almadini had said she was \u201cinclined\u201d to throw the case out<\/a>, after Carey\u2019s team had requested it be dropped as the claims failed the court\u2019s \u201cextrinsic test for substantial similarity in protectable expression\u201d.<\/p>\n Back in 2020, Carey\u2019s \u2018All I Want\u00a0For\u00a0Christmas Is You\u2019\u00a0became a UK Number One for the first time ever<\/a>, 26 years after it was first released.\u00a0This month,\u00a0it also achieved a record-breaking 20th\u00a0week at the top spot on the US Billboard Hot 100 chart<\/a>.<\/p>\n This year,\u00a0the top spot\u00a0went to Kylie Minogue\u2019s new festive single \u2018XMAS\u2019<\/a>,\u00a0a feat that made her the first female solo artist to top the charts in four different decades.<\/p>\n \u2018XMAS\u2019 is also the first Amazon Music Original single ever to reach Number One,\u00a0and\u00a0Kylie recently spoke to\u00a0NME\u00a0<\/i>about the track\u2019s success<\/a>.\u00a0\u201cIt\u2019s been amazing,\u201d she said. \u201cLike with all songs, once they go out into the world, all you want is for them to go out and have their own life.
